Terms and Conditions of Use

1. Purpose

These Terms and Conditions of Use (TCU) govern access to and use of the Youmethem platform, published by KPDIGITAL.

Youmethem provides a digital solution enabling sports and wellness organizations to manage bookings, offers, credits and, where applicable, online payments.

2. Definitions

User: any individual using the platform to book a service.

Provider: any individual or legal entity offering services through Youmethem.

Platform: all digital services accessible via the website and associated interfaces.

Account: personal space created by a user or provider.

Booking: the action of reserving a service offered by a provider.

3. Acceptance of the Terms

Use of the platform implies full and unconditional acceptance of these Terms.

Youmethem reserves the right to modify these Terms at any time. The applicable version is the one in force on the date of use of the services.

4. Account Creation

Users and providers agree to provide accurate, complete and up-to-date information.

Each user is responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account.

In the event of fraudulent or unauthorized use, the user must immediately inform Youmethem.

5. Services Provided

The platform allows in particular:

- Viewing available services and schedules;

- Online booking of services;

- Management of bookings and cancellations;

- Management of credits, packages or subscriptions defined by providers;

- Online payment through third-party payment service providers.

Youmethem does not guarantee any minimum number of bookings to providers.

6. Online Payment

When online payment is activated, transactions are processed by a secure third-party payment provider.

Applicable banking fees are defined by the payment provider and remain independent from Youmethem.

Youmethem shall not be held liable for payment refusals, banking incidents, processing delays or technical malfunctions attributable to the payment provider.

7. Credits, Packages and Validity

Packages, credits or subscriptions offered via the platform are defined and configured by each provider.

Their validity period, usage conditions and cancellation rules are exclusively determined by the provider.

Youmethem acts solely as a technical support provider and is not responsible for expiration, non-use or refund of credits.

8. Role of Youmethem

Youmethem acts solely as a technical intermediary.

The contractual relationship is concluded directly between the user and the provider.

Youmethem does not provide any sports, medical or wellness services.

9. Provider Responsibility

Providers are solely responsible for:

- Compliance with applicable laws and regulations;

- Maintaining appropriate professional insurance;

- Safety of premises and equipment;

- Compliance with health and safety standards;

- Quality of the services provided.

10. Cancellations and Refunds

Cancellation policies are defined by each provider.

Youmethem applies the configured cancellation rules technically but does not decide on refunds and cannot be held liable for disputes relating to cancellations.

11. User Conduct

It is prohibited to use the platform for fraudulent purposes, to disrupt its operation, to bypass payment systems or to distribute unlawful content.

Any breach may result in suspension or termination of the account.

12. Suspension and Account Termination

Youmethem may suspend or terminate an account in case of violation of these Terms, fraudulent activity or threat to platform security.

Except in serious cases, prior notice will be given to the concerned user.

13. Platform Availability

Youmethem endeavors to ensure continuous availability of its services.

However, access may be temporarily suspended for maintenance, updates or in cases of force majeure.

No compensation shall be due in such cases.

14. IT Security

Youmethem implements reasonable technical measures to ensure data security.

However, as no system is entirely secure, Youmethem shall not be held liable in the event of cyberattacks, hacking or external intrusion.

15. Electronic Evidence

Digital records generated by the platform constitute proof of transactions carried out.

In the event of a dispute, data stored by Youmethem shall prevail unless proven otherwise.

16. Intellectual Property

All content available on the platform (texts, images, logos, code, interface) is protected by intellectual property laws.

Any reproduction or use without prior written authorization is prohibited.

17. Personal Data

The processing of personal data is governed by Youmethem’s Privacy Policy.

Users have the rights provided by applicable regulations (access, rectification, deletion, objection).

18. Cookies

Cookies may be used to improve user experience and platform functionality.

19. Force Majeure

Youmethem shall not be held liable in the event of unforeseeable and unavoidable circumstances preventing normal performance of the service.

20. Governing Law and Jurisdiction

These Terms are governed by French law.

In the event of a dispute, exclusive jurisdiction is granted to the courts within the jurisdiction of KPDIGITAL’s registered office, unless mandatory legal provisions provide otherwise.
